Terms of Service

1. The service

AKASHA OMS provides an order management platform (catalog, orders, fulfillment, inventory, payments integration, shipment tracking, notifications) via akashaoms.com and api.akashaoms.com. By creating an account or using the API you agree to these terms.

2. Your account

• You are responsible for keeping your credentials and API keys confidential.
• One account per legal entity; trial accounts may be limited in volume.
• You must be authorized to act for the business whose orders and customer data you process.

3. Your data; your customers’ data (data processing terms)

3.1 Roles. As between you and us: you are the controller of the personal data of your customers and staff that you submit to the service; we are the processor, processing it solely on your documented instructions to provide the service.

3.2 Our commitments as processor. We will: process personal data only on your instructions; ensure persons authorized to process it are bound by confidentiality; implement appropriate technical and organizational measures (see our Privacy Policy, section 7); not engage another processor without notice and an objection right — current subprocessors are listed in the Privacy Policy and may be updated there with 14 days’ notice; assist you with data subject requests and with consultations with supervisory authorities; notify you without undue delay on becoming aware of a personal data breach affecting your data; and delete or return your personal data at the end of the service, at your choice.

3.3 Your commitments as controller. You are responsible for the lawfulness of the data you submit (notices, consents, and legal bases for your customers), for configuring webhook endpoints you control, and for export/retention decisions for your own legal obligations.

4. Acceptable use

• No unlawful goods, fraud, or misuse of the platform to harm third parties.
• No probing, scanning, or load-testing the production service without written consent.
• No reselling access to the platform without a written agreement.

5. Billing

Paid plans are billed through Stripe. Card details are processed by Stripe; we never see or store card numbers. Failed renewals may suspend an account after notice.

6. Availability & liability

The service is provided “as is”. We target high availability and durable event delivery but do not warrant uninterrupted operation. To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. Nothing in these terms limits liability that cannot be limited by law (including under the GDPR).

7. Termination

You may close your account at any time; we may suspend or terminate for breach or unlawful use with notice where practicable. On termination we delete your data per the retention schedule in the Privacy Policy, subject to legal retention duties.

8. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding conflict-of-law rules, unless mandatory consumer law provides otherwise. The courts at the operator’s seat (see the Impressum) have jurisdiction for business customers.
